It should go without saying that any parenting plan should put the well-being and the needs of the child first. Several state laws presume that shared parenting is in the best interests of the child.  Advocates of shared parenting argue that children are better served when both parents play a significant role in their life.

Making Mutual Decisions For The Child

In order for shared parenting to work, both of the parents must be able to communicate well with each other and be able to make mutual decisions about their child.

These decisions may include:

  • Parenting time arrangements
  • Financial responsibilities
  • Education & schooling decisions
  • Medical care
  • Religious upbringing
  • Extracurricular activities

Many parenting agreements include a process for resolving disagreements when parents can’t come to a compromise. Parents should consider how they will resolve these disputes if and when they arise.

Shared Custody & Child Support in Massachusetts

Shared custody laws can vary widely from state to state. Take a look at Massachusetts General Laws:PartII:TitleIII:Chapter208: Section 31 regarding shared custody. This defines Shared physical custody as: “a child shall have periods of residing with and being under the supervision of each parent.”

Another variable from state to state is the effect that a shared parenting plan would have on child support.  Massachusetts Law states “An award of shared legal or physical custody shall not affect a parent’s responsibility for child support. An order of shared custody shall not constitute grounds for modifying a support order absent demonstrated economic impact that is an otherwise sufficient basis warranting modification.”
